The smoking gun is that she changed her story to pretend she couldn't remember what happened and hearing voices AFTER she retained Reddington. None of the medical experts that interviewed her immediately after the murders believed she exhibited any signs of psychosis. She had perfect recall of the event and admitted to knowing it was wrong. Then a few days later after she hired Reddington all of a sudden she couldn't remember anything and started claiming a voice told her to do it. That's the smoking gun. Hearing voices is something only a lawyer specializing in this kind of defense would know to coach her up on because that takes care of the "no volition" element of NGRI.

So there is in fact a smoking gun, and a big one at that. But the legal test for insanity doesn't require that. The prosecution only had to prove two things:

• That she knew it was wrong (morally or legally.) She admitted to this while not acting psychotic or pretending to have amnesia before Reddington coached her up.
• That she had volition, i.e., ability to stop herself. The planning surrounding getting her husband out of the house disproves that she had no control over her actions. Having no volition means she would have tried to do it regardless of who was present, whether it was her husband, law enforcement, or anyone else.
• Her planning combined with the admission of wrongdoing and changing her story after lawyering up proves that she is full of shit beyond any doubt, not just "reasonable" doubt.
•  She has already confessed to killing her children. And there was already a copycat child murder last week. They have to prosecute her.
• the multiple prescriptions and claiming to take them erratically was to create the idea they interacted and 'did something'. shes a qualified nurse who googled 'where is the carotid artery' then stabbed anywhere on her neck but there leaving only shallow cuts.
• blood evidence on the window frame shows she dangled by one hand before the fall. Selected a time window when the husband who could stop her, was away, and she immediately got to it. the first kid she murdered was the only kid that might have been able to resist and escape. Clear evidence of premeditation was all there.
