The helicopter was OVER THE WATER over 200FT above the ground. The aircraft was at over 490FT and descending. There is no way
#1 the helicopter did not see the airplane
#2 the pilot did not know he was passing at the business end of a busy airport

the pilot did not know about the NASDE RNAV approach or the STARS for
RWY 33 that require pilots to go MANUAL just south of LEAVY.
The
helicopter was flying directly into the path of landing aircraft. A
trained sane non malicious pilot would have crossed the field or been on
the east side of 295. The helicopter basically did the aviation
equivalent of driving on the wrong side of the Autobahn.
There is a point where pilots on STARS landing on runway 33 are required
to TURN OFF THE AUTOPILOT and go manual because they are flying
directly toward the Capitol, Washington Monument and the White House at
that point so they AUTOPILOT MUST BE TURNED OFF.
No sane and
nonmalicious pilot would be in a helicopter over the Potomac between
LEAVY and runway 33 while the runway is active and aircraft are landing.
1000 feet is the bare minimum separation in aviation, the helicopter shouldn't have been anywhere near there. The path into the end of the runway is a restricted area.
